Public contract-offer

Terms of use and shopping with the help of the Internet resource bracelet.lviv.ua is governed by a public client agreement.

The owner of the online store is bracelet.lviv.ua, Matsala Yury Ivanovich, or a person authorized by the owner, hereinafter referred to as the “Seller”, guided by Art. 633 of the Civil Code of Ukraine, offers an unlimited number of individuals, referred to as the "Buyer", jewelry made of precious metals and precious stones, accessories and jewelry, as well as similar products, in an assortment under the terms of this Public Agreement, which are given below:

1. Terms used in the Public contract.

1.1. The bracelet.lviv.ua online store owner, individual entrepreneur Matsala Yury Ivanovich.

1.2. A public contract - a contract of sale, establishes for all Buyers, except for those who, in accordance with the legislation of Ukraine, are granted privileges, the same conditions for the purchase of the Goods on the terms of a public offer from the moment of acceptance by the Buyers.

1.3. Public offer - Seller’s offer addressed to any natural or legal person in accordance with art. 641 of the Civil Code of Ukraine to conclude an agreement with him under the conditions stipulated by the Public contract.

1.4. Acceptance - the provision by the Buyer of the full and unconditional consent of the Seller to the proposal to conclude a Public contract under the conditions stipulated by the Public contract, shall be drawn up:

  • by ordering the Buyer, made through the order basket in the online store of the Seller at the web address bracelet.lviv.ua;
  • by ordering the Buyer by making a phone call to the number indicated in the Seller’s online store at the web address bracelet.lviv.ua;
  • by ordering the Buyer in the retail stores of the Seller; These actions indicate that the Buyer has accepted the Public Offer.

1.5. Goods are jewelry made of precious metals and precious stones, jewelry and accessories in quantity, assortment and price, presented in the online store of the Seller at the web address bracelet.lviv.ua.

1.6. A significant drawback - a drawback that makes it impossible or unacceptable to use the goods in accordance with its intended purpose, has arisen through the fault of the seller, after its elimination is manifested again for reasons independent of the Buyer and has one of the following signs: be eliminated; - elimination of the deficiency requires more than 14 (fourteen) calendar days - the deficiency makes No significantly different than provided by the Public contract.

2. Acceptance of a Public Contract.

2.1. For the Buyer, the confirmation of the full and unconditional acceptance of the Public Offer is one of the following ways to place an order by the Buyer, namely:

2.1.1. Buyer's order, made through the order basket in the online store of the Seller.

2.1.2. Buyer's order in the online store of the Seller, made by sending a message to an e-mail address or a phone call to the numbers indicated in the web address bracelet.lviv.ua.

2.1.3. Buyer's order, made in retail stores of the Seller (methods provided for in clauses 2.1.1., 2.1.2. and 2.1.3. clause 2.1. of the Contract, hereinafter referred to together or separately referred to as “Order”).

2.2. From the moment the Seller receives the Order, the Public Contract shall be deemed concluded without its subsequent signing.

3. The subject of a public contract.

3.1. The Seller undertakes to transfer the Goods to the Buyer, belongs to the Seller on the basis of ownership, and the Buyer undertakes to accept the goods and pay for them in the manner and under the conditions stipulated by the Public contract.

3.2. The main characteristics of the Goods are contained in the Seller’s online store at the website’s web address in the description under each respective Goods.

4. Product quality and warranty period.

4.1. The quality of the Product complies with the standards, specifications, other technical documentation, which establishes requirements for its quality or samples (standards). Compliance of the Goods with the requirements of the legislation of Ukraine is confirmed by the method and in the manner provided for by the current legislation of Ukraine.

4.2. The seller guarantees the goods for a period of 1 (one) month from the date of receipt.

4.3. If the Buyer discovers defects in the Goods during the warranty period, the Buyer has the right to:

4.3.1. for free elimination of defects in the goods within a reasonable time.

4.4. If the Buyer discovers, during the warranty period, significant defects in the Goods, the Buyer has the right to:

4.4.1. on termination of the Open Contract and return of the sum of money paid for the Goods;

4.4.2. require replacement of the goods with the same or similar ones from those available from the Seller.

4.5. Delivery of the Goods to eliminate defects in the nearest point of sale of the seller during the warranty period or after the end of the warranty period is at the expense of the Buyer.

5. Terms of delivery of goods.

5.1. Delivery of goods is carried out in ways that are provided in the online store of the Seller at the web address - www.bracelet.lviv.ua / delivery at the time of the Order by the Buyer.

5.2. delivery of goods is carried out throughout the territory of Ukraine.

5.3. In the case of delivery of the Goods by the Seller, the responsibility for the safety of the goods until the moment they are transferred to the Buyer is borne by the Seller.

5.4. In the case of delivery of goods by third parties (courier service, forwarding service, etc.), the responsibility for the safety of the goods until the moment they are transferred to the Buyer is borne by the appropriate third party.

5.5. The seller undertakes to deliver the goods to the buyer within the following terms:

5.5.1. no later than - 10 (ten) working days from the moment of receiving the Order in the event of the availability of the Goods at the warehouse of the Seller;

5.5.2. in another period agreed by the Buyer and the Seller.

5.6. The ownership of the goods passes to the Buyer from the moment of payment of 100 (one hundred)% of the value of the Goods in any manner provided.

6. Price and payment procedure.

6.1. The price of the Goods is determined on the basis of the prices indicated in the Seller’s online store at the web address bracelet.lviv.ua at the time of making the Order by the Buyer and requires confirmation by the Seller after receiving the order from the Buyer.

6.2. The buyer undertakes to pay the cost of goods in the following order:

6.2.1. When making an Order for the manufacture of the Goods, the Buyer undertakes to pay 100 (one hundred)% of the cost of the Goods within 1 (one) working day from the date of placing the Order.

6.3. Payment for the Goods shall be made by the Buyer on the basis of the invoice issued by the Seller or otherwise agreed by the Seller and the Buyer. All payments are made in the national currency of Ukraine - hryvnia.

6.4. Payment by the Buyer of the Goods is made in one of the following ways:

6.4.1. transfer of funds to the current account of the Seller in a banking institution. The day of the payment is the day the funds are credited to the current account of the Seller.

7. Responsibility.

7.1. For non-fulfillment or improper fulfillment of obligations under the Public Contract, the Seller and the Buyer are liable under the current legislation of Ukraine.

7.2. If the Seller violates the terms of delivery of the Goods as stipulated by the Public Contract, the Seller undertakes to pay the Buyer a penalty in the amount of a double discount rate of the National Bank of Ukraine for each day of delay in delivery times.

7.3. In the event of an early termination of the Public Contract at the initiative of the Seller prior to the delivery of the Goods to the Buyer, the Seller shall return to the Buyer 100 (one hundred)% advance payment for the Goods.

7.4. Payment of a penalty or fine does not relieve the Buyer or the Seller from the fulfillment of obligations under the Public Contract.

7.5. Seller and / or Buyer are exempt from liability for failure to fulfill obligations under this Public Agreement in cases where there were force majeure circumstances (force majeure) that arose after the conclusion of the Public agreement as a result of emergency actions that could not be foreseen and / or prevented by clever methods .

7.6. The presence and duration of force majeure circumstances (force majeure) must be duly confirmed by the relevant document of the competent authority.

8. The term of the Public contract.

8.1. The public contract comes into force from the moment of its acceptance by the Buyer and is valid until the moment of full fulfillment of obligations by the Seller and the Buyer.

8.2. A public contract may be terminated early:

8.2.1. by mutual agreement of the seller and the buyer;

8.2.2. at the initiative of the Buyer by notifying the Seller about this within 14 (fourteen) calendar days from the date of receipt of the Goods;

8.2.3. By the tribunal's decision;

8.2.4. in case of occurrence of force majeure circumstances (force majeure), as evidenced by the relevant document of the competent authority.

9. Other conditions.

9.1. All disputes arising in connection with the non-fulfillment or improper fulfillment of the terms of the Public Contract shall be resolved through negotiations.

9.2. Disputes that could not be resolved through negotiations are subject to judicial review in accordance with the current legislation of Ukraine.

9.3. In cases not regulated by this Public Contract, the Seller and the Buyer are guided by the current legislation of Ukraine.

9.4. The invalidity of certain provisions of the Public Agreement does not provide for the invalidity of the Public Agreement as a whole, since it can be assumed that this Public Agreement could be concluded without making such provisions in it.

9.5. The titles of the articles of the Public Contract are used solely for convenience and do not in any way affect their content and interpretation.

9.6. The Buyer confirms that from the moment of placing the Order, he (the buyer) has been notified of the submission of his own personal data voluntarily submitted to the Seller in the personal data database “Contractors”.

9.7. The Buyer allows the Seller to carry out all actions that, in accordance with the Law of Ukraine “On Personal Data Protection”, is the processing of personal data of the Buyer, in accordance with the formulated mate their processing, which is to ensure the implementation of economic, civil law, tax relations and relations in the field provided by the constituent documents, accounting documents, relations in the field of human resource management and the implementation of such activities with such data, allows you to attach a person to a certain object in its activities in accordance with the Civil Code of Ukraine, the Economic Code of Ukraine, the Tax Code of Ukraine, the Law of Ukraine "On Accounting Russian accounting and financial reporting in Ukraine. ”

9.8. In order to achieve the goal of processing the personal data base, the Buyer grants permission to process his personal data to the extent provided by him at the time of concluding the Agreement with the Seller and necessary for the realization of the above purpose.

9.9. The buyer confirms that from the moment of placing the Order, he (the buyer) with the rights that are provided for by the Law of Ukraine "On the protection of personal data" is familiar.

9.10. The Buyer gives his consent to the transfer (dissemination) of his personal data included in the personal data base solely for the purposes provided for in this Agreement to entities related to the realization of this goal.

9.11. The buyer consents to the storage of his personal data for 75 (seventy five) years.

9.12. The Buyer allows access to personal data that is entered into the personal data base to third parties in cases and in the manner prescribed by the current legislation of Ukraine, and does not require notification of the transfer (distribution) of personal data included in the personal data database “Counterparties”, if such transfer distribution) is carried out exclusively for the purposes provided for in this Agreement.

9.13. Claims from Buyers are accepted by the Seller at: 37000, ul. Shevchenko 30, city., Ukraine.

9.14. Warranty repair of the Goods is carried out by the Seller at: 37000, ul. Shevchenko 30, city., Ukraine.
